Small Business Commissioner of Victoria
Small Business Commissioner (SBC)
The SBC's Office conducts mediations under the Retail Leases Act 2003 (the RLA). Many cases often are resolved at mediation and it is an excellent and cost effective way to resolve most disputes
Before lodging an application with the SBC, it is important to first obtain sound legal advice so that you are aware of your rights and strengths of your case. You don't want to sell yourself short
It is also important to seek proper advice as soon as possible so that you do not inadvertently harm the future outcome of your case if it fails to settle by giving away too much or the wrong information during mediation

Mediation
The Mediation sanctioned by the SBC's Office is an excellent forum to resolve disputes
The Mediator's role is to act impartially and to assist Landlords and Tenants to settle their disputes. The Mediator does not provide legal advice
Attempting to resolve a dispute without seeking proper legal advice may result in unintended consequences.
Devil in the detail
Once an agreement is reached, care needs to be taken to prepare a settlement agreement that reflects your bargain and does not mistakenly given away any rights
The appropriate mechanisms must also be in place to enforce the settlement agreement if there is a breach
